Terms of Service

Welcome to 3DOCR (“Company,” “we,” “us,” or “our”). These Terms of Service ("Terms") govern your access to and use of our services (“Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant that you meet this eligibility requirement.

2. User Responsibilities

Compliance with Laws: You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.

Prohibited Content: You may not upload, transmit, or otherwise make available any material that is illegal, illicit, infringing, harmful, or otherwise objectionable (“Prohibited Content”).

Responsibility for Uploaded Content: You are solely responsible for all data, material, or content (“Content”) you upload to our Services. We are not liable for any illegal, unethical, or harmful Content you submit. Additionally you accept liability for any and all Content you submit.

Indemnification for Illicit Material: If you upload Prohibited Content, you agree to indemnify us for all associated costs, damages, and liabilities. You further agree to pay a penalty of up to $100,000 per instance of uploading such material.

All or a portion of penalties may be waived at the discretion of the Company.

3. Service Use and Limitations

No Guarantee of Accuracy: Our OCR and analysis processes are provided on an "as-is" basis. We do not guarantee that our analysis or results will perfectly reflect the content provided, especially in cases involving niche fonts, handwriting, or other challenging inputs.

Abuse of Systems: Abuse of our systems, is defined as including but not limited to:

• Crafting data to bypass our methods of charging as determined by the Company.
• Making excessive or unauthorized requests as determined by the Company.
• Exploiting bugs or vulnerabilities as determined by the Company.

You agree to pay penalties of up to $1,000 per abusive request.

All or a portion of penalties may be waived at the discretion of the Company.

Right to Suspend or Terminate: We reserve the right to suspend or terminate access to our Services for any activity we deem abusive or in violation of these Terms.

4. Fees and Payments

Service Charges: Fees for using the Services will be communicated to you and are subject to change with prior notice.

Additional Charges: Penalties for violations, including abusive use or uploading Prohibited Content, may be charged in addition to standard fees.

Overage Fees: You acknowledge and agree that overage fees may apply as usage exceeds allocated limits. We reserve the right to charge these overage fees on a metered basis, at a frequency determined by us and at a price point communicated to you.

5. Intellectual Property

All rights, title, and interest in our Services, including but not limited to software, algorithms, and documentation, remain with the Company. Your use of the Services does not grant you ownership or intellectual property rights in the Services.

6. Limitation of Liability

No Liability for Uploaded Content: We are not liable for any damages resulting from Content you or other users upload.

Service Limitations: To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, even if we have been advised of the possibility of such damages.

7. Data Security

We take commercially reasonable steps to protect the security and integrity of your Content. However, you acknowledge that no system can guarantee complete security, and you upload data at your own risk.

8. Privacy

By using the Services and/or creating an account with us, you agree to our Privacy Policy, which governs how we collect, use, and disclose your data.

9. Termination

We may terminate your access to the Services at any time, with or without cause, for violations of these Terms or for any activity that may harm the Company or other users.

10. Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of Ontario, Canada.

Arbitration: Any disputes arising out of these Terms or the Services will be resolved exclusively through binding arbitration, except as otherwise prohibited by law.

11. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. We will notify you of significant changes, and your continued use of the Services constitutes acceptance of the updated Terms.

12. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the Services and supersede all prior agreements or understandings.
